By placing an order with us you automatically agree to our terms and conditions. AMENDMENT OF TERMS AND CONDITIONS
These terms and conditions may be amended in whole or in part by Pacific Vision International Ltd from time to time. Amendments will be effective immediately upon posting of the amended terms and conditions on this web site. You are responsible for ensuring you are familiar with the latest terms and conditions. Your continued use of the services represents your agreement to be bound by the terms and conditions as amended.
This quotation is only effective on your confirmation of acceptance to Pacific Vision International, and will expire after 30 days if not formally accepted.
These rates are based on your information supplied. Pacific Vision reserves the right to re-negotiate should these vary.
Items on quotation are subject to availability. Models frequently change and we may not be able to supply the quoted item but we will endeavour to give an equal or better replacement model.
Pricing is subject to change with or without notice (this excludes a current quotation).
Our online order form is a secure order form. All details are encrypted until they reach us.
Your personal and credit card details are required when you order so we can process and ship your purchases to you as quickly as possible. When the order is transmitted your details are encrypted - your personal information is immediately isolated on a secure server SSL (Secure Socket Layer) not accessible from the internet.

Our site uses an order form for customers to request information, products, and services. We collect visitor's contact information (like their email address) and financial information (like their credit card numbers). Contact information from the order form is used to process orders. Financial information that is collected is used to bill the user for products and services.
Pacific Vision International Ltd ensures that all personal information being voluntarily submitted to us in the processing of your order (to be used for record and billing purposes, etc.), inclusive, but not limited to, credit card and other personal information, will be kept strictly confidential and used; by Pacific Vision International Ltd, its authorized representatives and employees; for the strict purpose for which it was intended, and for the benefit of the Subscriber.
We agree not to share, rent, sell or release this information to any individual, entity or third party, for any reason, without the specific written consent of the Subscriber; with exception as required by Law, Regulation or Governmental Authority.
Our payment conditions are pre-pay. On receipt of full payment Pacific Vision will endeavour to ship goods to customers as soon as possible.
For our account payment is due on the 20th day of the month following invoice. Failure to do so may result in the revoking of credit facilities without notice, until payment is made.
Unless otherwise agreed, each payment will be made to Pacific Vision by the Customer is to be made on the due date by direct credit to Pacific Visions nominated bank account as specified by Pacific Vision from time to time. Each payment by the customer to Pacific Vision is to be made free of any conditions and without any deduction or withholding for any other account by way of set-off, counterclaim or otherwise.
Where credit card details have been provided, the Customer agrees to authorize Pacific Vision to debit their credit card for any costs incurred relating to the Agreement that are outstanding at the end of this Agreement.
For the purpose of calculation of payment due under this agreement and determination of the timing of those payments, each day shall and at 4pm on that day, and any payments received or required to be made after 4pm shall be deemed to have been made or received after the end of the day.
Payments that are made to or accepted by Pacific Vision prior to the due date of payment by the Customer shall be held unallocated by Pacific Vision and shall not be credited to the Customer’s account until the due date for payment
Pacific Vision may, at its absolute discretion, decline to accept any payment (other than a payment in full of all amounts due under this Agreement) from a Customer until the due date of that payment has arrived.
Pacific Vision is entitled to charge the Customer a Dishonour Fee of $25.00 if the cheque provided by the Customer as payment for the due sums is dishonoured or payment made by direct credit to Pacific Vision’s nominated bank account for the same purpose fails at any time during the term of the Agreement. The Dishonour Fee is subject to change by Pacific Vision at its sole discretion from time to time.
If the Customer does not make any payments due under this Agreement by the date specified for payment and such failure to comply is not remedied on or before the 14th day after the day on which compliance was due, then the Customer shall pay to Pacific Vision, upon demand, interest as liquidator damage on the unpaid amount from the due date until the date of payment at the rate from time to time specified by Pacific Vision but not exceeding 33.5% per annum together with all reasonable costs incurred solicitor/client costs.
Overdue accounts will incur interest charges at 2% above the ANZ National Bank overdraft interest rate.
Continued non-compliance will result in the account being closed, and the account being handed to a debt collection company to instigate debt recovery action to recover the amounts outstanding.
All costs of collection including debt collector’s fees, solicitor’s costs, charges and expenses on a solicitor and owner client basis will be added to the account.
Any legal action required to cover or reclaim costs, fees, or outstanding account balances will be initiated in New Zealand.
All good remains the property of Pacific Vision International Ltd until the goods have been paid for in full.

Pacific Vision will always go out of our way to ensure our customers are happy with their purchases and we will always try to remedy issues. However we are not obliged to refund if the buyer simply changes their mind or no longer requires the goods after taking delivery. Where Goods may be returned for a refund in some cases delivery charges may not be refundable.
If a product is faulty, and it falls under warranty we will either replace or repair the item. The warranty is a back-to-base warranty, meaning any freight charges involved in returning the item to us, are covered by you, the end user.
As a result of copyright laws a refund or exchange is only available for software purchases if the product is defective. Software purchases are still guaranteed under the Consumers Guarantees Act.
CONSUMER GUARANTEES ACT 1993
The Consumer Guarantee Act sets out minimum standards for goods sold by Pacific Vision International Ltd. In the event that goods sold are not of good quality or are faulty, Pacific Vision International Ltd has the right to decide whether to offer a repair, replacement or a refund.
FAIR TRADING ACT 1986
The Fair Trading Act is designed to protect the customer being misled, either intentionally or unintentionally. This applies to all aspects of the promotion and sale of goods and services including: pricing; where the product was made; where the product is from; the meeting of New Zealand safety standards; availability of products in store and the sales techniques used. The Commerce Commission enforces the Fair Trading Act
